Similar to most corporations, associations contract with vendors, prepare budgets, notice and run meetings, set reserves, manage revenue and elect both officers and directors. These volunteer boards and their contracted association managers deal with industry specific issues such as conflicts between owners, collections, common property maintenance and enforcement of governing documents.
As part of our homeowners’ association practice, we interpret and analyze the association’s governing documents, such as the Master Deed if the association is a South Carolina Horizontal Property Regime or the Declaration of Covenants & Restrictions if the association is a planned unit development or neighborhood. We analyze to confirm that the governing documents are consistent with South Carolina and Federal Law, including the South Carolina Horizontal Property Act and the South Carolina Corporate Code. When disputes arise and should laws change, we problem solve and amend the documents to ensure that they cater to and improve the community. We attend board meetings and annual members meetings.
